Right of Withdrawal (Widerrufsbelehrung)

This information applies to consumers in the European Union, the EEA, and Germany who purchase a Producer membership for bySurf TV. Producer membership is a paid digital streaming service (ongoing platform access to a catalogue we may update), operated by bySurf Studios from Germany.

Under EU and German consumer law (including the Consumer Rights Directive and, for German contracts, BGB and EGBGB), distance contracts generally include a 14-day right of withdrawal. For a streaming subscription to a platform, that right is the right that applies to digital services. It is not lost merely because you start watching. You can still withdraw within 14 days after the contract is concluded. If you asked us to start the service immediately and then withdraw, you may owe a reasonable proportionate amount for the time already used.

1. Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (for example an email or our electronic withdrawal function). You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Use our electronic function Withdraw from contract (Vertrag widerrufen). It is a two-step process: you submit the declaration, then confirm it (Widerruf bestätigen). You will receive an immediate confirmation by email on a durable medium, including date and time of receipt.

2. Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw, minus any proportionate amount you may owe as described below. We will use the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you expressly requested that the streaming service begin during the withdrawal period, and you then withdraw, you shall pay us a reasonable amount corresponding to the proportion of the service already provided up to the point when you informed us of your withdrawal, compared with the full coverage of the contract (for example, days of access already used in the first billing period).

If you withdraw before we have started performance, you owe nothing for the service.

3. Immediate access does not cancel your 14-day right

Producer membership is a digital service. Starting to stream, unlocking the catalogue, or using Producer perks during the first 14 days does not by itself end your right of withdrawal.

At checkout we ask you to expressly request that we start the service immediately. That request lets us give you access at once. It is not a waiver of the 14-day right. You may still withdraw within 14 days. The consequences are those in section 2 (possible proportionate charge for use already made).

The 14-day right of withdrawal is separate from cancelling future renewals (section 5). After the 14-day period, you can still stop the subscription from the next billing date by cancelling renewal.

4. Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract. You may also use Withdraw from contract (Vertrag widerrufen) instead.

5. Cancelling your subscription (distinct from withdrawal)

Ending your recurring Producer membership for future billing periods is not the same as withdrawing from the initial distance contract within 14 days.

• Cancel renewal: Use Cancel contracts here (Verträge hier kündigen), then Cancel now (jetzt kündigen). You keep access until the end of the period you already paid, unless you choose extraordinary cancellation.
• Withdraw within 14 days: Use Withdraw from contract (Vertrag widerrufen) if you are exercising your statutory right of withdrawal from the initial purchase.

6. Pre-contract information

The following key information is also shown immediately before you place a paid order:

• Main characteristics: Paid access to stream the Producer catalogue (member-only documentaries and related perks such as ad-free viewing and Discord lounge access where offered) for the selected billing period. The catalogue may change. You must be 18 or older. Some titles are graphic.
• Price: $2.99 per month or $28.70 per year (USD, 20% off vs twelve monthly payments). Stripe may show a converted amount in your local currency at checkout. Taxes may be added at checkout where required.
• Contract term: The first term is one month or one year. The contract then renews automatically for the same interval until you cancel renewal. There is no additional minimum term beyond the period you select and pay.
• Billing and cancellation of renewal: Recurring until you cancel via Cancel contracts here. Cancellation of renewal takes effect at the end of the current paid period unless you choose extraordinary cancellation. You may update your payment method via Stripe.
• Payment methods: Processed by Stripe. Methods typically include credit and debit cards and other methods Stripe enables for your country. We do not store your full card number.
• Delivery: Digital access is provided online. If you request immediate start at checkout, access begins after successful payment.
• Withdrawal: 14 days as set out above. Electronic function: Withdraw from contract.
